Manta Splash LLC – Swim Lesson Services
Liability Release & Assumption of Risk
I. Waiver of Liability
Swimming is a physical activity with inherent risks, including but not limited to slips, falls, drowning, near-drowning, muscle strains, allergic reactions, or other injuries. Participation is voluntary, and I accept these risks on behalf of myself and/or my child.
II. Liability Release
In consideration of services provided by Manta Splash LLC, I release, discharge, indemnify, and hold harmless Manta Splash LLC, its owners, instructors, employees, contractors, and agents from any and all claims, demands, actions, or causes of action for injuries, illness, damages, or death arising out of participation in swim lessons, including any negligent acts by Manta Splash LLC or its agents, except in cases of gross negligence or willful misconduct.
III. Risk Acknowledgment & Assumption of Risk
I understand that swimming involves strenuous activity. I am responsible for ensuring that I and/or my child are physically fit and medically cleared to participate. I acknowledge that my child’s participation carries inherent risks, which I voluntarily assume. Pre-existing medical conditions must be disclosed.
IV. Medical Disclosure, Allergies, and Special Needs
I agree to disclose any allergies, medical conditions, or special needs that may affect participation. Manta Splash LLC is not liable for incidents or reactions arising from undisclosed conditions. Participants with medical concerns should provide a doctor’s clearance before lessons.
V. Pool Conditions & Off-Site Liability
Clients are responsible for ensuring the pool meets safety standards, including pH, chlorine, clarity, and safe temperature. Manta Splash LLC is not responsible for hazards, maintenance, or unsafe conditions of off-site pools.
VI. COVID-19 & Health Assumption of Risk
I acknowledge the risk of exposure to communicable illnesses, including COVID-19. I agree not to attend lessons if I or my child show symptoms of contagious illness. Manta Splash LLC reserves the right to refuse participation to maintain safety.
VII. Emergency Medical Consent
I authorize Manta Splash LLC to provide CPR and/or basic first aid in emergencies. I consent to EMS if necessary and accept responsibility for associated costs.
VIII. Limitation of Liability
Manta Splash LLC is not liable for indirect, incidental, special, or consequential damages arising from participation in swim lessons.
IX. Indemnification
I agree to indemnify and hold harmless Manta Splash LLC from any claims brought by myself, my child, or any other party arising from participation in swim lessons.
X. Parent/Guardian Consent for Minors
If the participant is under 18, I am signing on behalf of my minor child and affirm that I have full legal authority to consent to these terms.
XI. Force Majeure
Manta Splash LLC is not liable for cancellations, rescheduling, or inability to provide services due to events beyond its control, including severe weather, pool equipment failure, or government-mandated closures.
Manta Splash LLC – Swim Lesson Services
Policies
I. Participant Responsibility & Conduct
I agree that myself and/or my child will follow all instructions from Manta Splash instructors and adhere to pool rules and safety guidelines. Failure to comply may result in termination of lessons without refund.
II. Pool Water
Clients are responsible for ensuring that the pool water conditions (pH, chlorine, clarity, and temperature) meet recommended standards before each lesson. Properly maintained water helps provide a safe and effective learning environment.
III. Observation Guidelines
For the best learning experience, parents/guardians are encouraged to watch from a distance to minimize distractions and allow the instructor and participant to focus.
IV. Cancellation, Makeup, and Lesson Policies
Cancellation Within 24 Hours: If a lesson is canceled less than 24 hours before the scheduled start time, the lesson will be considered completed, fully charged, and no makeup will be allowed.
Late Arrivals: If a client arrives 10 minutes or less late, that time will be deducted from the lesson. If the client arrives more than 10 minutes late, the lesson is forfeited with no refund or makeup. If the instructor arrives on time and the client cancels, the lesson will be considered completed and fully charged.
Makeups: Must be used within the same month. Lessons canceled during the last week of the month may roll over, with makeup lessons completed within 2 weeks following the end of the month.
No Holding of Lessons / Extended Breaks: Lessons cannot be paused, held, or reserved for later. All paid lessons must be completed within the same month. Clients who choose to stop, take an extended break, or go on a trip must complete their remaining lessons in that month. Any lessons not completed within the month will be marked as completed, fully charged, with no makeup allowed, and the client may lose their lesson spot.
Current Clients with Lessons on Hold: Pending lessons must be completed by March 31, 2026. Any lessons not completed by this date will be marked as done, with no makeup allowed, after which the standard “No Holding of Lessons / Extended Breaks” policy applies.
Weather: Lessons may be canceled or rescheduled due to unsafe conditions, including lightning or severe storms, at the instructor’s discretion.
V. Media & Photo Release
By consenting, parents/guardians allow Manta Splash LLC to take photos and videos of their child during lessons for training, instructional purposes, promotional materials, marketing, social media, website content, or advertisements. Participation in social media promotions is voluntary and can be withdrawn in writing.
Manta Splash LLC – Lifeguard Services
Liability Release & Assumption of Risk
I. Scope of Mobile Lifeguard Services
Manta Splash LLC provides mobile lifeguard services at client-provided locations, including private residential pools, community pools, hotels, and public or semi-public aquatic facilities.
Lifeguard services are limited to general aquatic supervision and emergency response. Lifeguards are not responsible for swim instruction, childcare, pool maintenance, chemical balance, crowd control outside the immediate pool area, or one-on-one supervision unless explicitly agreed to in writing.
Services may be provided by Manta Splash LLC owners, employees, or independent contractors.
II. Assumption of Risk
I understand and acknowledge that swimming and aquatic activities involve inherent risks, including but not limited to slips, falls, drowning, near-drowning, head or spinal injuries, water-related illness, medical emergencies, or death.
I voluntarily assume all risks associated with aquatic activities during the time mobile lifeguard services are provided, whether occurring in the water, on the pool deck, or in surrounding areas.
III. Waiver and Release of Liability
In consideration of mobile lifeguard services provided by Manta Splash LLC, I release, waive, discharge, and hold harmless Manta Splash LLC, its owners, lifeguards, employees, independent contractors, and agents from any and all claims, demands, losses, damages, injuries, illness, or death arising out of or related to aquatic activities or use of the pool or facility.
This release includes claims arising from the ordinary negligence of Manta Splash LLC or its representatives, to the fullest extent permitted by Florida law.
This release does not apply to gross negligence or intentional misconduct.
IV. Pool Conditions & Off-Site Liability
I acknowledge that the pool or aquatic facility is owned and maintained by the client or facility.
Manta Splash LLC is not responsible for pool maintenance, chemical balance, water clarity, facility defects, electrical hazards, slippery surfaces, or unsafe conditions outside the lifeguard’s reasonable control.
V. Medical Conditions & Emergency Care
I agree to disclose any known medical conditions, allergies, or special needs that may affect safe participation.
I authorize Manta Splash LLC lifeguards to provide CPR, first aid, and emergency response and consent to the activation of emergency medical services (EMS) if necessary. I accept responsibility for all related medical costs.
VI. Weather, Visibility & Environmental Conditions
Lifeguard services may be paused, delayed, or terminated due to unsafe conditions, including lightning, severe weather, poor water visibility, extreme heat, overcrowding, or other hazards.
All safety-related decisions are made at the lifeguard’s discretion and do not constitute a breach of service.
VII. Limitation of Liability
Manta Splash LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to mobile lifeguard services.
VIII. Force Majeure
Manta Splash LLC is not liable for cancellations, delays, or service interruptions caused by events beyond its control, including severe weather, facility closures, equipment failure, power outages, or government-mandated restrictions.
Manta Splash LLC – Lifeguard Services
Policies
I. Booking & Payment
All mobile lifeguard services must be booked in advance.
Full payment is required to confirm and reserve the scheduled date and time.
Clients are charged for the full number of hours booked, regardless of late start or early completion.
Additional time may be requested if available and will be billed at the standard hourly rate.
Payment must be received via the approved payment method prior to the start of services.
II. Cancellation & Rescheduling Policy
Client-Initiated Cancellations:
24+ hours notice: One hour of booked time (based on client’s hourly rate) is non-refundable. Remaining time may be rescheduled, subject to lifeguard availability.
Less than 24 hours notice: Full charges apply and rescheduling is not guaranteed.
Same-Day Cancellations / No-Shows:
Cancellations after the scheduled start time, or failure to provide pool access at the scheduled time, are fully charged.
Weather-Related Cancellations:
Services may be delayed, paused, or canceled due to unsafe weather conditions (e.g., lightning, severe storms).
If Manta Splash LLC cancels before the scheduled start, the booking may be rescheduled or credited at our discretion.
If canceled after the scheduled start, full charges apply for the booked time.
Note: Clients are encouraged to provide a safe and accessible environment to avoid preventable cancellations.
III. Client & Facility Responsibilities
Clients or facilities are responsible for ensuring:
The pool or aquatic facility is legally permitted for use.
The pool is properly maintained and meets safety standards.
Required safety equipment is accessible (rescue ring, rescue pole, clear deck access).
Pool rules are posted and enforced.
Manta Splash LLC is not responsible for:
Facility defects, maintenance issues, chemical imbalance, water clarity, or hazards outside the lifeguard’s reasonable control.
IV. Supervision & Authority
Lifeguards provide general aquatic supervision and emergency response only.
The assigned lifeguard has full authority to:
Enforce safety rules
Limit participation
Clear the pool
Pause or terminate services due to unsafe conditions or behavior
Failure to follow lifeguard instructions may result in immediate service termination without refund.
V. Unsafe Behavior
Unsafe behavior is strictly prohibited, including but not limited to:
Running or rough play
Diving in shallow water
Intoxication or impaired behavior
Disregard for lifeguard instructions
Event organizers and parents/guardians are responsible for communicating and enforcing behavior expectations with participants.
VI. Minimum Requirements & Staffing
Bookings are based on lifeguard availability and staffing requirements.
Manta Splash LLC reserves the right to adjust staffing, decline service, or cancel bookings if minimum safety requirements cannot be met.
The client may be required to pay for rescheduling or additional staffing if minimum safety requirements change after booking.
VII. Emergencies & Incident Reporting
Lifeguards may activate emergency procedures and contact EMS when necessary.
An incident report may be completed and provided to the client when applicable.
Manta Splash LLC is not responsible for injuries occurring due to client or participant negligence or pre-existing conditions.
VIII. Policy Changes
Manta Splash LLC reserves the right to update these policies at any time.
Updated policies apply to all future bookings.
IX. Policy Acknowledgment
By booking mobile lifeguard services, the client acknowledges that they have read, understood, and agree to comply with Manta Splash LLC’s Mobile Lifeguard Services Policies.
